Waste Collection Camden Service Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Camden provides waste and rubbish collection services to domestic and commercial customers. By making a booking, confirming an order or allowing our operatives to collect waste from your premises, you agree to be bound by these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions, you must not use our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Waste Collection Camden, we, us, our means the waste collection service provider supplying the services to you.
1.2 Customer, you, your means the person, company or organisation who requests or receives the services.
1.3 Services means any waste, rubbish, recycling, bulky waste, or related collection, clearance, loading, transportation and disposal services we provide.
1.4 Premises means the property, building, site, accessway or land where the waste is to be collected.
1.5 Waste means any materials you ask us to remove, including household rubbish, commercial waste, garden waste, furniture, appliances, construction and demolition debris, and recyclable items, but excluding any prohibited or hazardous items as defined in these Terms and Conditions and under applicable law.
1.6 Booking means a request for services made by you and confirmed by us by email, text message, telephone confirmation or other written form.
2. Scope of Services
2.1 We provide scheduled and ad hoc waste collection services for households and businesses within our operating area, which includes Camden and selected surrounding areas. Availability is subject to route planning, vehicle capacity and local access conditions.
2.2 The exact nature of the services, including the type and volume of waste to be collected, collection date, time window and any special requirements, will be agreed at the time of booking.
2.3 We reserve the right to refuse to collect waste that we reasonably consider to be hazardous, prohibited, incorrectly described, unsafe to handle, or in breach of applicable waste regulations.
3. Booking Process
3.1 You may request a booking by telephone, email or through our online enquiry or booking systems where available.
3.2 When making a booking, you must provide accurate and complete information, including:
a the collection address and any access restrictions
b your contact details
c the type and approximate volume or weight of waste
d whether any large, heavy or awkward items are included
e any parking, loading or timing constraints at the premises.
3.3 We may provide an estimated price based on your description of the waste and the services required. All estimates are subject to our operative s assessment on arrival. If the actual waste volume, weight, type or access conditions differ from your description, we may adjust the price accordingly before starting work.
3.4 A booking is only confirmed when we issue a confirmation by email, text message or other written communication. We are not obliged to accept any booking request.
3.5 You must ensure that a responsible person is available at the premises at the agreed time to provide access, confirm the waste to be removed and authorise any additional charges where applicable.
4. Access and Parking
4.1 You are responsible for ensuring safe and reasonable access to the premises for our vehicles and operatives, including arranging any necessary permissions for parking, loading or entry.
4.2 Any parking fees, permits or fines incurred as a direct result of instructions given by you or your representatives may be added to your invoice.
4.3 If access is obstructed, unsafe, illegal or significantly more difficult than described at the time of booking, we may at our discretion:
a cancel the booking and charge a call out or cancellation fee, or
b propose an amended price to reflect additional time or resources required.
5. Customer Responsibilities
5.1 You confirm that you are either the owner of the premises or have the authority of the owner or occupier to arrange waste collection services.
5.2 You are responsible for:
a separating waste as required under local and national waste regulations
b ensuring that any bags, containers or loose items are reasonably accessible and not contaminated with prohibited or hazardous waste
c informing us in advance of any known hazards, including sharp objects, asbestos, chemicals, faulty appliances or structural risks at the premises
d providing accurate information about the type, condition and quantity of waste.
5.3 You warrant that the waste presented for collection is owned by you or that you have full authority to dispose of it. You indemnify us against any claim made against us by a third party alleging unlawful removal of waste from the premises.
6. Payments and Charges
6.1 Our charges are based on factors such as waste type, volume, weight, loading time, labour involved, access, parking and disposal fees. Pricing will be set out in our quote or rate card, as updated from time to time.
6.2 Unless otherwise agreed in writing:
a payment is due in full on completion of the collection
b we accept payment by cash, debit or credit card, bank transfer or other methods we may publish
c for business customers with approved accounts, payment terms will be specified on the invoice.
6.3 All prices are quoted exclusive of VAT unless otherwise stated. Where VAT is applicable, it will be charged at the prevailing rate.
6.4 If payment is not received when due, we may:
a charge interest on overdue amounts at the statutory rate from the due date until payment is received in full
b suspend further services until all outstanding sums are paid
c recover from you all reasonable costs incurred in enforcing payment, including legal and debt recovery costs.
7. Cancellations, Amendments and Waiting Time
7.1 You may cancel or amend your booking by contacting us directly.
7.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally apply. We reserve the right to charge for any non refundable costs we have incurred on your behalf.
7.3 If you cancel less than 24 hours before the scheduled collection time, or if our operatives attend the premises and are unable to complete the collection due to your act or omission, we may charge a cancellation or call out fee to cover our costs and lost time.
7.4 If you wish to change the scope of the services, including the volume or type of waste or the collection time, we will use reasonable efforts to accommodate the amendment but cannot guarantee availability. Revised pricing may apply.
7.5 Reasonable waiting time is included in our standard rates. If our operatives are kept waiting for longer than a reasonable period due to delays on your part, we may charge additional waiting time at our standard hourly rate.
8. Service Delivery and Performance
8.1 We will use reasonable care and skill in providing the services and will make reasonable efforts to carry out collections on the agreed date and within the agreed time window.
8.2 Any times quoted for arrival or completion are estimates only and do not form part of a guaranteed service level unless explicitly confirmed in writing as a timed service.
8.3 We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including traffic conditions, road closures, vehicle breakdowns, severe weather, accidents, emergencies or industrial action.
8.4 We reserve the right to use subcontractors or partner operators to fulfil all or part of the services, provided that we remain responsible for the proper performance of the contract.
9. Waste Handling and Regulations
9.1 We operate in accordance with applicable UK waste management legislation and any relevant local waste regulations. This includes duties relating to the handling, transport and disposal of controlled waste.
9.2 We may issue a waste transfer note or similar documentation where required by law or where requested by commercial customers. You must keep copies of such documentation as required for regulatory compliance.
9.3 You must not present for collection any waste classified as hazardous or special waste unless we have expressly agreed to handle such waste and hold the necessary licences and permits to do so. Prohibited items may include, but are not limited to:
a asbestos and asbestos containing materials
b clinical, medical or biological waste
c corrosive, flammable, explosive or toxic substances
d gas cylinders, certain chemicals and solvents
e large quantities of batteries or electrical equipment requiring specialist handling.
9.4 If we discover prohibited, hazardous or improperly described waste after removal, we may:
a return the waste to you or arrange for its specialist treatment or disposal
b charge you for all additional costs, charges, handling, storage and disposal fees incurred
c report breaches of waste regulations to the relevant authorities where required.
9.5 Title to waste transfers to us at the point we load it onto our vehicle, provided that the waste is lawful for us to accept. If waste is found to be unlawful for us to possess, title will be deemed never to have passed and you will remain the owner.
10. Liability and Insurance
10.1 We will take reasonable care to avoid damage to your property while providing the services. However, you acknowledge that waste removal, especially of bulky items, may carry some inherent risk of minor scuffs or marks to floors, walls or doorways.
10.2 Our liability for any direct physical damage to your property caused by our negligence shall be limited to the cost of repair or replacement, up to a maximum aggregate amount per incident which reflects our current level of insurance cover. Details of such cover are available on request.
10.3 We are not liable for:
a any loss or damage arising from inaccurate information provided by you
b pre existing damage or defect in your property or items
c any loss of profits, revenue, business, contracts, anticipated savings, goodwill or data
d any indirect or consequential loss or damage, whether arising in contract, tort or otherwise.
10.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
11. Customer Property and Security
11.1 You must remove or clearly separate any items you do not wish to be taken away. Our operatives may not be familiar with the value or intended use of particular items and rely on your clear instructions.
11.2 We are not responsible for any items that are removed and disposed of as waste where it was reasonable for us to consider that such items had been presented for collection.
11.3 You must keep pets, children and vulnerable persons away from collection areas for their own safety while the services are being provided.
12. Complaints and Disputes
12.1 If you have any concerns or complaints about our services, you should contact us as soon as possible, providing full details and any supporting information.
12.2 We will investigate complaints in a fair and timely manner and will work with you to find an appropriate resolution where we are at fault.
12.3 Raising a complaint does not entitle you to withhold payment of undisputed sums owed to us.
13. Data Protection and Privacy
13.1 We collect and process personal data in order to manage bookings, provide services, issue invoices, and meet our legal obligations.
13.2 Your details may be used to contact you about your booking, to send invoices and receipts, and to follow up on service quality. We will handle your personal data in accordance with applicable data protection laws.
13.3 We may share necessary information with subcontractors, payment processors, insurers, regulatory authorities and other third parties where required to deliver the services or comply with legal obligations.
14. Amendments to these Terms
14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulations, industry practice or our operational requirements.
14.2 The version in force at the time of your booking will govern the contract between you and us. A copy of the current Terms and Conditions is available on request.
15. Severability
15.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable.
15.2 Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.
16. Entire Agreement
16.1 These Terms and Conditions, together with any written quotation or confirmation we issue, constitute the entire agreement between you and us relating to the provision of the services and supersede any prior oral or written agreements, understandings or representations.
16.2 You confirm that you have not relied on any statement, promise or representation not set out in these Terms and Conditions or in any written quotation or confirmation we have provided.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services shall be governed by and construed in accordance with the laws of England and Wales.
17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services, whether in contract, tort or otherwise.
By proceeding with a booking or using our waste collection services, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
